1. Acceptance of Terms
Welcome to Patternaly. By accessing or using our website at patternaly.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
2. Description of Service
Patternaly is an AI-powered pattern generation service that allows users to create seamless, tileable patterns from text descriptions. Our Service includes:
- Text-to-pattern AI generation
- Multiple art style options (Watercolor, Oil Painting, Cartoon, 3D Render, Kawaii)
- Batch pattern generation (1-4 patterns at once)
- Pattern export and download functionality
- Free and paid subscription plans
3. User Accounts
3.1 Account Creation
To access certain features of our Service, you must create an account. You may register using Google OAuth. You agree to provide accurate and complete information during registration.
3.2 Account Security
You are responsible for maintaining the security of your account and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion.
4. Subscription Plans and Payments
4.1 Free Plan
Free accounts do not include AI generation credits. A paid plan is required for AI image and pattern generation, HD export, and commercial use.
4.2 Paid Plans
We offer paid subscription plans (Basic, Pro, Team) with additional features including:
- Monthly credit allocations
- High-resolution exports
- Commercial usage license
- Extended history retention
4.3 Billing
Paid subscriptions are billed monthly or annually in advance. Payments are processed securely through our payment provider, Creem. By subscribing, you authorize us to charge your payment method on a recurring basis.
4.4 Credits
Each pattern generation consumes 1 credit. Unused credits do not roll over to the next billing period. Credits have no cash value and are non-transferable.
5. Acceptable Use Policy
You agree NOT to use our Service to:
- Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Generate content that infringes on intellectual property rights of others
- Generate NSFW (Not Safe For Work), pornographic, or sexually explicit content
- Generate content depicting violence, gore, or harm to individuals
- Generate content that promotes discrimination, hatred, or harm against any individual or group
- Generate content that impersonates real individuals without their consent
- Attempt to bypass any content filters or safety measures
- Use automated systems or bots to access the Service without our permission
- Interfere with or disrupt the Service or servers
- Violate any applicable laws or regulations
AI Content Moderation: Our AI models are designed to refuse generation of content that violates these guidelines, including NSFW, violent, or otherwise inappropriate content. Attempts to circumvent these safeguards may result in account suspension or termination.
6. Intellectual Property Rights
6.1 Our Intellectual Property
The Service, including its design, features, and content (excluding user-generated content), is owned by Patternaly and protected by intellectual property laws. You may not copy, modify, or distribute our Service without permission.
6.2 Your Generated Content
Free Accounts: Free accounts do not include AI generation credits. Commercial rights are not included unless you are on a paid plan.
Paid Users: Patterns generated under paid plans (Basic, Pro, Team) include a commercial license. You own the rights to your generated patterns and may use them for:
- Print-on-demand products (T-shirts, phone cases, etc.)
- Physical products and merchandise
- Digital products and downloads
- Client work and commercial projects
- Marketing and advertising materials
6.3 Restrictions
You may NOT:
- Claim that AI-generated patterns are entirely human-created when disclosure is required
- Use generated patterns in a way that violates any laws
- Resell or redistribute the patterns as standalone digital assets (e.g., selling pattern packs)
- Use patterns to create competing AI generation services
- Generate patterns that intentionally replicate trademarked logos, brand identities, or copyrighted designs
- Use prompts that reference specific copyrighted characters, artworks, or brand names
6.4 AI-Generated Content Disclaimer
Important Notice Regarding AI-Generated Content:
- AI-generated patterns are created by machine learning models trained on publicly available data. While we strive to ensure originality, we cannot guarantee that generated patterns are completely free from similarity to existing copyrighted works.
- Patternaly does NOT claim ownership of AI-generated patterns, nor do we guarantee that such patterns do not infringe on third-party intellectual property rights.
- You are solely responsible for ensuring that your use of generated patterns does not infringe on any third-party copyrights, trademarks, or other intellectual property rights.
- We recommend conducting your own due diligence, including reverse image searches, before using generated patterns for commercial purposes.
- If you receive a copyright claim related to a pattern generated through our Service, you are responsible for addressing such claims.
By using our Service, you acknowledge and accept these limitations and agree to use generated content responsibly and in compliance with applicable intellectual property laws.
7. Disclaimers
7.1 Service Availability
The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or secure.
7.2 AI-Generated Content
AI-generated patterns may not always meet your expectations. Results depend on the prompts provided and the capabilities of the AI model. We do not guarantee specific outcomes or quality levels.
7.3 Third-Party Services
Our Service relies on third-party providers (including Hugging Face for AI processing). We are not responsible for the availability or performance of these third-party services.
8. Limitation of Liability
To the maximum extent permitted by law, Patternaly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Patternaly and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you generate using our Service
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Shenzhen, China.
11. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
